These Terms and Conditions ("Terms") govern your use of GKAI Capital's borrower intake website, Quick App submission flows, and related communication channels, including email and SMS messaging. By accessing or using our services, you agree to these Terms. If you do not agree, you must discontinue use immediately.

1. Definitions

• Company: GKAI Capital, 8425 NW 41st Street, Suite 354, Miami, FL 33166.
• Service: The borrower intake forms, Quick App flows, and related communications provided by GKAI Capital.
• User: Any person submitting information, interacting with intake steps, receiving SMS or email messages, or otherwise using GKAI Capital services.

2. Eligibility

You must be at least 18 years old to submit a Quick App, request information, or receive SMS or email communications. By using our services, you represent that you meet this requirement.

3. Purpose of Services

GKAI Capital provides borrower intake services designed to collect initial borrower intent and loan information ("Quick App Data") and assist in connecting borrowers with appropriate lending options. GKAI Capital is not a lender and does not make credit decisions, underwrite loans, or guarantee approval for any financial product.

4. Modifications to These Terms

We may update these Terms from time to time. Revisions will be reflected by the "Last updated" date above. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.

5. Third-Party Services

In the course of providing services, we may use third-party tools and service providers for operations, communications, analytics, and security. We are not responsible for third-party services that are outside of our reasonable control. Your use of any third-party services is subject to their applicable terms.

6. SMS Communications

By providing your phone number through a web form or by texting START to (800) 577-8957, you consent to receive SMS messages from GKAI Capital. SMS messages may include Quick App confirmations, follow-up requests, loan program information, educational information, appointment updates, and other borrower-intake-related messages.

You may opt out at any time by replying STOP to any message. After you opt out, you will no longer receive SMS messages unless you opt in again. For assistance, reply HELP or contact us at admin@gkaicapital.com or (800) 577-8957.

Standard message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages. GKAI Capital does not sell your phone number or SMS consent data and does not share them with third parties for their own marketing purposes. Opt-in and opt-out events may be logged and retained for operational and compliance purposes.

7. Accuracy of Information

You agree that information you provide through borrower intake forms or SMS interactions is accurate, truthful, and complete to the best of your knowledge. Inaccurate or incomplete information may affect your ability to be matched with an appropriate lending option or receive accurate communications.

8. Limitation of Liability

To the fullest extent permitted by law, GKAI Capital shall not be liable for any indirect, consequential, incidental, punitive, or special damages arising out of or related to your use of our services, including SMS or email communications.

In no event shall GKAI Capital's total aggregate liability to any user exceed $100, regardless of the number of submissions, interactions, or communication methods.

9. No Financial Advice or Guarantees

GKAI Capital does not provide financial, legal, or tax advice. Nothing on our website or in our communications should be interpreted as financial guidance or a guarantee of loan approval, loan terms, or funding outcomes. All lending decisions are made solely by independent third-party lenders.

10. Termination

We reserve the right to suspend or terminate access to our website or communication services at any time, without notice, for conduct that violates these Terms or is otherwise harmful to GKAI Capital, other users, or third parties.

11. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

12. Relationship to Other Policies

These Terms apply to the GKAI Capital borrower intake environment. Additional terms, disclosures, and policies may apply to other GKAI Capital services and environments.
